Terms of Service

These terms apply to buildmetrx.com (the “Site”), run by BuildMetrx, Inc. (“BuildMetrx”, “we”, “us”). By using the Site you agree to them. If you do not agree, please do not use the Site. The BuildMetrx application at app.buildmetrx.com is covered by a separate customer agreement, not by these terms.

What the Site is for

The Site describes BuildMetrx, lets you ask to be told when it launches, and lets you apply for or request a product demo. Submitting a form is not a purchase and does not create a contract for the software. We choose demo participants at our discretion, and anything we agree about a demo or a pilot is set out separately in writing.

Product information

Descriptions, screenshots, example numbers, module names, and pricing on the Site are illustrative. They describe the product as it is planned or as it exists at the time of writing, and may change before and after launch. Nothing on the Site is an offer, a quote, or a guarantee of any result, saving, or feature.

What you submit

When you fill in a form you agree that the information is accurate, that you are authorized to give it to us (for example on behalf of your company), and that you will not submit someone else’s personal information without their permission. How we handle what you submit is described in our Privacy Policy.

Acceptable use

When using the Site you agree not to:

• submit false, misleading, or automated form entries;
• probe, scan, overload, or attempt to gain unauthorized access to the Site or the systems behind it;
• copy, scrape, or reproduce the Site’s content for commercial use without our written permission;
• use the Site in any way that breaks the law.

Intellectual property

The Site, its text, design, graphics, and code, and the BuildMetrx name and logo belong to BuildMetrx or its licensors and are protected by copyright and trademark law. You may view and print pages for your own evaluation of the product. QuickBooks and Intuit are trademarks of Intuit Inc.; other product and company names are the trademarks of their owners. Mentioning them does not mean they are affiliated with or endorse BuildMetrx.

Links to other sites

The Site may link to websites we do not control. We are not responsible for their content or their privacy practices.

No warranty

The Site is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties about it, express or implied, including that it will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or current.

Limitation of liability

To the fullest extent the law allows, BuildMetrx will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising from your use of the Site. Our total liability for any claim connected with the Site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow these limits, so some of them may not apply to you.

Indemnity

You agree to defend and hold BuildMetrx and its officers, employees, and agents harmless from claims, losses, and expenses (including reasonable legal fees) that arise from your breach of these terms or your misuse of the Site.

Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute connected with the Site will be brought in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction. If you are a consumer in a country whose law gives you the right to sue at home, nothing here takes that right away.

Changes

We may update these terms. The date at the top of the page shows the current version, and continuing to use the Site after a change means you accept it. If a provision of these terms is found unenforceable, the rest stay in effect.
